Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kanvro (Pty) Ltd ("Kanvro", "we", "us", or "our") governing your access to and use of the Kanvro platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Kanvro is a social media analytics platform designed for digital marketing agencies. The Service allows agencies to connect their clients' Facebook, Instagram, and LinkedIn accounts, aggregate social media metrics, and present analytics through a unified dashboard. The Service is read-only — we do not create, modify, or delete content on connected social media accounts.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your login credentials
• You must be at least 18 years old to use the Service
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorised use of your account

4. Subscription and Payment

4.1 Plans

The Service is offered on a subscription basis with the following tiers: Ignite (R5,500/month), Amplify (R12,000/month), and Command (R25,000/month). Each tier includes specific features and client limits as described on our pricing page. All prices are in South African Rand (ZAR) and exclude VAT unless stated otherwise.

4.2 Billing

Subscriptions are billed monthly in advance. Payment is due on the date specified in your invoice. We reserve the right to suspend access to the Service if payment is not received within 14 days of the due date.

4.3 Cancellation

You may cancel your subscription at any time by contacting us. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers) to access the Service without our written permission
• Share your account credentials with third parties outside your organisation
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to collect data for purposes not authorised by the connected social media account owners

6. Social Media Account Connections

By connecting social media accounts to the Service, you represent and warrant that you have the authority to grant us access to those accounts. You are solely responsible for obtaining any necessary permissions from the social media account owners. You may disconnect any account at any time through the Service settings.

7. Intellectual Property

The Service, including its design, features, code, and documentation, is the intellectual property of Kanvro (Pty) Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your active subscription. Social media data displayed through the Service remains the property of the respective platform and account owners.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree to our collection and use of data as described in the Privacy Policy.

9. Agency Responsibilities

As an agency subscriber, you are responsible for:

• Ensuring you have proper authorisation from your clients to connect and access their social media accounts
• Managing team member access and permissions within your agency
• Ensuring your team members comply with these Terms
• The accuracy of client information entered into the Service

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service depends on third-party APIs (Meta Graph API, LinkedIn REST API) which may experience outages or changes outside our control. We will make reasonable efforts to notify you of planned maintenance and significant service disruptions.

11. Limitation of Liability

To the maximum extent permitted by South African law, Kanvro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. The Service is provided for reporting and analytics purposes only — business decisions made based on dashboard data are your sole responsibility.

12. Indemnification

You agree to indemnify and hold harmless Kanvro, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Data associated with your account will be deleted within 30 days of account closure, subject to any legal retention requirements.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
